What we do
Nobody loses these on the facts. They lose them not knowing there were any.
One side knows the rules, what things actually transacted at, and which customs are merely customs. The other side has a deadline and a signature block. That is the entire contest, and it is decided long before anyone sits down.

Establish the facts
Statute, regulation, customary practice, transacted numbers. Each traced to a source and dated. If we cannot cite it, it does not go in, however useful it would have been.

Separate secured from available
A position a rule backs is a different animal from one that needs the other side to agree. Every line is marked. Nobody should walk into a room arguing from a premise that will not hold.

Hand over instruments
Not a summary of what a good letter contains. The letter. Position statements, comparison tools, objection scripts, all finished, all going out under your own name.
The doctrine
Secured, or available. Never blurred together.
Every figure carries one of two marks. Secured means a rule backs it: a cap, a notice period, a charge with nothing behind it. Available means it is winnable, but only if the other side says yes.
It sounds like pedantry right up until you are sitting across a table. Claim something you are not owed and everything else you say gets discounted with it, including the parts that were solid. This is the most important thing we publish, and we publish it free.
